TERMS AND CONDITIONS

 

Kabiru Abu ( Zabu Group Ltd ) fulfil a customer’s order in accordance with our obligations under the Sale of Goods Act 1979 and the Sale and Supply of Goods to consumers Regulations 2002.

Use of Products
2.1 All Kabiru Abu ( Zabu Group Ltd ) garments are solely for personal use and we will not be liable for any loss resulting from commercial use of our products.
2.2Legal Jurisdiction – All our customer contracts are governed by English law and shall fall under the exclusive jurisdiction of the courts of England.

Payment:
3.1 Payment of 50% of the total order price must be made upon the date that the order is confirmed, this is to cover the cost of materials and shipping.
3.2 The balance must be paid before delivery or at the final fitting stage before and goods can be taken away by the customer.

Quality 
4.1 Due to the uniqueness of every garment, it is not possible to guarantee that the finished item(s), especially those with distressed finishes, will have exactly the same colour, pattern, weave and finish as the item viewed either in store or during the appointment
4.2 In the unlikely event of the customer is not satisfied with the quality or fit of the ordered item(s). Kabiru Abu ( Zabu Group Ltd )will, after inspection of the goods, follow a policy of repair or replace and finally refund.
4.3 Kabiru Abu ( Zabu Group Ltd ) warrants that the garment description will correspond with the description indicated and agreed on the confirmed order confirmation form received by email.
4.4 Use of the Kabiru Abu ( Zabu Group Ltd ) website implies that all terms and conditions concerning orders, as outlined here have been accepted and agreed to.
4.5 Defects In the unlikely event that a manufacturing error has occurred, Kabiru Abu ( Zabu Group Ltd ) will follow our repair, replace, or refund policy as outlined.
4.6 We will require you to return the garment to us for inspection.
4.7 Kabiru Abu ( Zabu Group Ltd ) are not liable for defects resulting from a customer not following our care instructions.
4.8 Customer cloth All customers choosing to use their own fabric for their garments made by Kabiru Abu ( Zabu Group Ltd ) are obliged to, on demand and where necessary provide additional fabric where necessary.
4.9 Kabiru Abu ( Zabu Group Ltd ) has sole discretion on whether the cloth is deemed faulty or not.

Weight Gain/Loss 
5.1 Kabiru Abu ( Zabu Group Ltd ) manufactures each garment according to measurements taken manually by our skilled tailors.
5.2 Kabiru Abu ( Zabu Group Ltd ) shall not be held liable for any size variations due to sudden weight gain or loss
5.2 Kabiru Abu ( Zabu Group Ltd ) reserve the right to charge a discretionary alteration fee to cover cost of unplanned adjustments resulting from sudden planned or unplanned weight gain /loss.
5.3 Customers must make our tailors aware before embarking on any rigorous exercise or dieting plan in a bid to re-shape their bodies prior to delivery of their garments.

Order cancellation
6.1 The customer must check the order form and confirm all the details are correct at the time of purchase when confirming order by email .
6.2 It is understood that an order once finalised and confirmed, cannot be cancelled upon the commencement of the manufacturing process.
6.3 In the circumstance where the order consists of multiple garments, the start of the manufacturing process commences with the first suit.
6.4 Any agreement to cancel is at the discretion of Kabiru Abu ( Zabu Group Ltd ).
6.5 Any changes must be made to an order within 24 hours of the order confirmation. Making a change within the 24 hours of placing the order does not guarantee that a change can be made. Kabiru Abu ( Zabu Group Ltd ) will, where possible, endeavour to make the desired changes
6.6 Kabiru Abu ( Zabu Group Ltd ) cannot accept returns on the basis of a change of heart on the part of a customer.
6.7 Neither can Kabiru Abu ( Zabu Group Ltd ) accept returns where the customer requests a change to an existing order and Kabiru Abu ( Zabu Group Ltd ) cannot fulfil that change.
6.8 In the event of a dispute between the customer and Kabiru Abu ( Zabu Group Ltd ) over the details of the order, the details on the original order form is taken as the final order.

Returns and Refund
7.1 As the ordered goods are custom-made, they can neither be returned nor refunded, and the standard 28 day refund policy does not apply. This does not affect your statutory rights and does not apply to faulty goods.
7.2 Requests for returns or refunds must initially be supported by proof of purchase.
7.3 Every effort is made to avoid misunderstandings or disputes with our customers, and we reserve our right to adjust garments, so they meet the customers’ requirements.
7.4 In the case of refund, the client will be eligible for a full refund less the cost of any shipping costs previously incurred as these are considered complete at that point. Kabiru Abu ( Zabu Group Ltd ) retains full discretion on whether a product is deemed faulty or not.
7.5 Orders will only be refunded by the original method of payment less the cost of any credit card fees.

Shipping and Deliveries
8.1 All orders must be paid in full prior to delivery. It is understood that the turnaround and dispatch of orders may vary depending on
fabric availability. All indicated turnaround times are estimated and Kabiru Abu ( Zabu Group Ltd ) will endeavour to meet as close as possible the average turnaround time of between 5 and 6 weeks.
8.2 Kabiru Abu ( Zabu Group Ltd ) will not be responsible for delays resulting from situations within the customer control, such as the recipient not being available to accept delivery, or incorrect delivery details supplied.
8.3 We accept no liability for Courier delays or events beyond our control.
8.4 Customers who request deliveries are liable for all packaging, postal or courier fees. NB: we only use signed for delivery services.
8.5 UNITED KINGDOM – All packages are sent by the selected shipping method and typically take 1 to 5 days for UK delivery from the point of dispatch. Where a tracked shipping service has been selected, you will receive full tracking details once the order has been dispatched.
8.6 EUROPEAN UNION – Orders are sent by the selected shipping method from our UK distribution centre and typically take 2 to 7 days for delivery, from the point of dispatch. Where a tracked shipping service has been selected, you will receive full courier tracking details once the order has been dispatched. All orders are subject to UK VAT (sales tax) but are not subject to local import duties.
8.7 REST OF THE WORLD – Orders are sent by courier and typically take 5 to 14 days for delivery, from the point of dispatch. Where a tracked shipping service has been selected, you will receive full courier tracking details once the order has been dispatched. You will NOT be charged UK VAT (sales tax), but you will be liable for any local import duties.

Gift vouchers and Gift Experiences
9.1 Kabiru Abu ( Zabu Group Ltd ) Gift Vouchers and Gift Experiences can be exchanged for goods and tailoring services.
9.2 Neither Gift vouchers or Gift Experiences can be exchanged for cash and are valid for 12 months from the date of purchase.
9.3 If goods purchased total less than the value of the gilt voucher, any balance will be left as a credit on the customer’s account and can be redeemed against subsequent orders.
9.4 Vouchers are not transferable, and any attempt to modify them will void the voucher.
9.5 In the event of voucher loss Kabiru Abu ( Zabu Group Ltd ) would need written confirmation from the original purchaser before considering any appeal for replacement.
